LOTR RECRUITING & TRANSPORTATION SERVICES Carrier Portal & Software

By logging into the LOTR Gateway-Carrier Portal you agree to the following terms and conditions:

Definitions

For the purposes of this Carrier Portal & Software:

  • Sale means a unique purchase between the customer and LOTRR & Transportation. 

  • Recruitment Agency (referred to as either "the Company", "We", "Us" "Recruitment Agency" or "Our" in this Agreement) refers to Life on the Road Recruiting & Transportation Services LLC.

  • Country refers to: Texas, United States

  • Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.

  • Service refers to the Website, software and any other digital platform in which our products are housed.

  • Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.

  • Third-party Social Media Service refers to any website or any social network website through which a User can log in or create an account to use the Service.

  • Website refers to Life on the Road Recruiting, accessible from http://www.lotrrecruiting.com

  • Software refers to LOTR Gateway-Carrier Portal and/or Follow-up Testing Plan Management 

  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

No Professional Advice 

The Recruitment Agency does not engage in the rendering of legal advice associated with hiring drivers currently in the Return to Duty Process. The driver recruitment services performed by the Recruitment Agency is not to be used as a substitute for professional advice by a legal professional, FMCSA personnel consultations and/or otherwise applicable professional. You acknowledge that you will consult licensed professionals as applicable and make your own decisions before approving and/or acting upon hiring said drivers referred to you by the Recruitment Agency. Furthermore, I understand that:

  • It is the responsibility of my company as the motor carrier to vet, screen and qualify all potential candidates. I understand that the final approval for hire will come from my trucking company, my company's commercial insurance provider and/or other operating authority's vetting process.

  • I understand that driver candidates listed in this SAP Driver Online database have had a violation in the FMCSA's Drug and Alcohol Clearinghouse and are ready to return-to-duty to perform safety-sensitive functions as specified by the DOT.

  • I understand that supervision, direction and control of any driver candidates selected from this database are the sole responsibility of my trucking company.

  • I am aware and fully understand that LOTR Recruiting & Transportation Services, its leadership, its employees, contractors and subcontractors will not be held liable for any actions arising from the driver that is selected for hire from the LOTR Gateway online database of SAP Drivers.

  • I understand that LOTR Recruiting & Transportation Services does not offer legal advice associated with hiring drivers currently in the return-to-duty process. Any advice provided is associated with research of Department of Transportation CFRs, experience and expertise. To ensure the compliance and safety of my company, I will seek professional advice from a DOT Legal professional, FMCSA personnel consultant and/or otherwise applicable professional.

  • I understand that LOTR Recruiting & Transportation Services will have no liability whatsoever for any indirect, consequential, special, or incidental damages, regardless of how those damages are incurred. This includes, but is not limited to, damages for loss of business, loss of equipment, loss of property(internal or external), loss of opportunities and loss of profits.

Arbitration Agreement
While the Recruitment Agency does all possible to vet and secure the most suitable and qualified driver
candidate(s); the final approval for hire must come from your company, commercial insurance provider and/or operating authority's vetting process. The Client understands that the driver candidate may/may not have had a violation in the FMCSA's Drug & Alcohol Clearinghouse and is ready to Return to Duty to perform safety sensitive functions as specified by the DOT and/or may also have a criminal background.
It is important to note that supervision, direction and control of the placed driver candidate is the sole responsibility of your company. The client is fully aware and understands that the Recruitment Agency cannot and will not be held liable for any actions arising from the driver that you have selected to hire. Motor Carriers agree to hold our company and it's employees harmless of any actions arising from the hired driver or the subsequent tenure in which they choose to remain with the client 

 

Limited Damages

THE RECRUITMENT AGENCY WILL HAVE NO LIABILITY WHATSOEVER FOR ANY INDIRECT,
CONSEQUENTIAL, SPECIAL, OR INCIDENTAL DAMAGES, REGARDLESS OF HOW THOSE DAMAGES ARE INCURRED. THIS INCLUDES, BUT IS NOT LIMITED TO, DAMAGES FOR LOSS OF BUSINESS, LOSS OF EQUIPMENT, LOSS OF PROPERTY(INTERNAL OR EXTERNAL), LOSS OF OPPORTUNITIES, AND LOSS OF PROFITS, WHETHER BASED ON BREACH OF CONTRACT, BREACH OF WARRANTY, OR TORT, INCLUDING NEGLIGENCE. THE RECRUITMENT AGENCY'S TOTAL LIABILITY ARISING OUT OF THIS AGREEMENT SHALL BE LIMITED TO THE AGGREGATE AMOUNT THAT YOU PAID UNDER THIS AGREEMENT IN ASSOCIATION WITH THE HIRED DRIVER.

Cancellation Policy

Subscription services may be cancelled at anytime.
